1. Scope

These Terms apply to the SmartCheck website, support pages, mobile application, and related functions for license plate recognition, vehicle matching, patrol logs, handoff records, and audit support.

SmartCheck is published for business use in Japan and the United States only. We do not represent that the Service is available, lawful, or suitable in any other jurisdiction.

If an order form, quote, statement of work, or other written agreement conflicts with these Terms, the written agreement will control to the extent of the conflict.

2. Operator and Contracting Party

The Service is provided by a sole proprietor doing business under the trade name SmartCheck. The representative is Hiromu Sekiguchi.

If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

3. Trial, Sign-Up, and Fees

A 14-day free trial may be offered. Trial scope, storage limits, supported features, user counts, location counts, and support coverage are defined on the website, in a quote, or in separate written instructions.

The trial is for evaluation only. It may not be used for live production deployments, third-party service delivery, or any abusive, unlawful, or security-sensitive use. We may shorten, suspend, or terminate a trial if needed for legal, security, billing, or abuse-prevention reasons.

Contract formation, upgrades, renewals, invoicing, and payment are handled through the website, quotes, order forms, invoices, or separate written agreements. The current mobile application does not offer in-app purchases.

4. Lawful Use and ALPR Responsibilities

You are responsible for confirming that you have lawful authority to monitor, photograph, match, retain, and act on vehicle-related information at each site where you use the Service.

You must establish and follow any notices, signage, access controls, training, audit practices, retention limits, destruction procedures, and disclosure rules required by applicable law or your internal policies. Where U.S. ALPR laws require a public written policy, you remain responsible for publishing and operating under that policy, including its purpose, authorized users, access monitoring, sharing restrictions, retention and destruction rules, and correction or complaint channels.

Recognition results, confidence scores, alerts, and labels are decision-support outputs only. Any enforcement, warning, access decision, towing instruction, or legal action must be based on human review and your own independent judgment.

5. Accounts, Devices, and Security

You must keep registration details accurate and current, manage administrator roles carefully, and control access to locations, devices, and shared rule sets.

You may not disclose, transfer, lend, or share account credentials, API keys, signed URLs, or device authentication artifacts with unauthorized persons. You are responsible for activity that occurs through your account or managed devices unless prohibited by mandatory law.

If you become aware of credential compromise, device loss, suspicious API activity, scraping, denial-of-service traffic, model extraction attempts, safeguard circumvention, or similar abuse, you must promptly notify us and take reasonable containment steps such as disabling affected devices, rotating credentials, preserving logs, and cooperating with the investigation.

  • Creating accounts with false or misleading registration details
  • Sharing devices or login sessions with persons who are not authorized administrators or operators
  • Selling, redistributing, transferring, sublicensing, or lending account credentials, API keys, signed URLs, shared links, or other access artifacts
  • Creating multiple or disguised accounts to bypass suspension, rate limits, trial limits, billing limits, or regional restrictions
  • Attempting unauthorized access, vulnerability discovery, or circumvention against our systems or the systems of other users

6. Customer Data and Rights

You retain rights in the vehicle data, recognition results, timestamps, location data, patrol logs, comments, and any on-device evidence images that you submit, generate, or store through the Service, subject to the rights required to operate, secure, maintain, and improve the Service.

All rights in the Service, apps, software, user interface, documentation, inference logic, templates, trained models, weights, parameters, features, and other underlying components remain with us or our licensors. Except for the limited use rights expressly granted by these Terms, no ownership or broader license is transferred to you.

Evidence images and thumbnails are intended to remain on the user device only and are not automatically uploaded to the cloud. If you choose to use sharing or text-sync functions, only metadata such as recognition results, recognition time, optional location data, and confirmation state may be synchronized based on your explicit action or consent.

You represent and warrant that you have all rights, notices, consents, and legal grounds required to collect and provide the data that you process through the Service. You may not submit unlawfully obtained data, unnecessary sensitive data, or third-party confidential information that you are not authorized to process.

7. Prohibited Conduct

You may not use the Service for unlawful surveillance, discriminatory treatment, reverse engineering, scraping, resale, security bypassing, competitive model building, or excessive load generation.

You may not rely on AI output alone to impose punitive, legal, or operational consequences without human review.

  • Using the Service in violation of law, public policy, privacy obligations, or site-specific authority requirements
  • Attempting to extract, infer, copy, analyze, reconstruct, decode, decompile, disassemble, reverse engineer, or otherwise discover source code, trained weights, model parameters, features, prompt structures, algorithms, safeguards, or other underlying components from the Service, the apps, the SDK, communications, outputs, or related materials
  • Using outputs, performance information, benchmarks, screens, or system behavior to develop, train, fine-tune, evaluate, sell, or provide any competing product, service, model, classifier, inference engine, or substantially similar functionality
  • Scraping, crawling, data mining, harvesting, hidden API access, or collecting data, outputs, or performance information through bots, scripts, or other automated means beyond what we expressly authorize
  • Bypassing, disabling, probing, or testing authentication, access controls, safety measures, review gates, billing limits, trial limits, regional restrictions, rate limits, or any other technical or contractual safeguard
  • Selling, sharing, transferring, sublicensing, redistributing, or making available credentials, API keys, signed URLs, shared links, evaluation environments, sandbox access, or other access rights to unauthorized parties
  • Introducing malware, harmful code, vulnerability probes, denial-of-service traffic, distributed denial-of-service traffic, unauthorized penetration testing, or any activity that disrupts or risks the availability, integrity, confidentiality, or normal operation of the Service or related infrastructure
  • Assisting, encouraging, enabling, or performing any of the foregoing for a third party

8. Changes, Suspension, and Termination

We may modify, suspend, or discontinue part of the Service for legal compliance, security, infrastructure, quality, regional availability, or business reasons.

We may suspend or terminate access if you violate these Terms, violate applicable law, create security or abuse risks, or fail to meet payment obligations.

Where reasonably necessary to prevent or stop credential compromise, scraping, competitive misuse, model extraction attempts, denial-of-service activity, malware distribution, or other security emergencies, we may act without prior notice, including by revoking tokens, blocking traffic, preserving logs, and sharing the minimum necessary information with relevant service providers, infrastructure operators, or authorities.

9. Disclaimer and Limitation of Liability

The Service is provided on an as-is and as-available basis. We do not guarantee uninterrupted availability, legal sufficiency for your specific deployment, absence of false positives or false negatives, or compatibility with every third-party workflow.

To the fullest extent permitted by law, and except for our willful misconduct or gross negligence, our aggregate liability is limited to the total fees paid by the relevant customer in the 12 months preceding the event giving rise to the claim. We are not liable for lost profits, indirect damages, consequential damages, special damages, or third-party claims.

10. Governing Law, Venue, and Contact

Unless otherwise stated in a separate written agreement, these Terms are governed by the laws of Japan. The Tokyo District Court or the Tokyo Summary Court will have exclusive jurisdiction as the court of first instance for disputes arising out of or relating to these Terms.
